BIG WIN!!! - NEW FDA COMMISH THROWS INDUSTRY A FLOATATION DEVICE

On July 28th, 2017 the newly appointed FDA Commissioner Scott Gottlieb announced a stunning shift in policy at the Food & Drug Administration. The vapor industry has been given nearly FIVE YEARS to remain on the market while the FDA develops a new, science based approach to regulating innovative, and potentially helpful new Tobacco Products such as Electronic Cigarettes.

In the FDA's statement:

"Tobacco use remains the leading cause of preventable disease and death in the United States, causing more than 480,000 deaths every single year. In addition to the devastating human toll caused mainly by cigarette smoking, tobacco also causes substantial financial costs to society, with direct health care and lost productivity costs totaling nearly $300 billion a year. A key piece of the FDA's approach is demonstrating a greater awareness that nicotine while highly addictive -- is delivered through products that represent a continuum of risk and is most harmful when delivered through smoke particles in combustible cigarettes."

"The overwhelming amount of death and disease attributable to tobacco is caused by addiction to cigarettes -- the only legal consumer product that, when used as intended, will kill half of all long-term users," said FDA Commissioner Scott Gottlieb, M.D. "Unless we change course, 5.6 million young people alive today will die prematurely later in life from tobacco use. Envisioning a world where cigarettes would no longer create or sustain addiction, and where adults who still need or want nicotine could get it from alternative and less harmful sources, needs to be the cornerstone of our efforts -- and we believe it's vital that we pursue this common ground."

Many of the more common-sense and practical requirements are still in place, such as facility registration, product registration, and ingredient listing, as well as more aggressive constituent testing. This is the biggest win we've ever had as an industry and we owe it to the new republican administration!

BUDGET DEAL REACHED - DEMS BLOCK PREDICATE DATE CHANGE

Unfortunately for vapers & millions of current and future smokers around the world #colebishop (an amendment which would have changed the predicate date for vapor products) did not make it into the house budget bill. This is a hard fought battle that we lost, but the war is not yet over. We have many on going strategies that require your immediate attention!

FROM THE AMERICAN VAPING ASSOCIATION: "We will continue to seek a permanent solution from Congress, but there is great need for immediate administrative action. HHS Secretary Tom Price must act to stop 99.9%+ of vapor products from being banned in August 2018."

I encourage you all to harness and use your anger and frustration righteously toward continued efforts to change the predicate date, to move back FDA deadlines, to raise awareness of deceit and misrepresentations made by our political adversaries and to organize politically against elected officials and outside organizations fighting us, a scientific community that often misleads, and with the media. And use it to convert and encourage smokers to safer alternatives.

"Democrats rejected Republican pressure to include 160 various riders that they deemed "poison pills."

Sen. Patrick Leahy (Vt.), the senior Democrat on the Appropriations Committee, hailed the deal as a triumph for his party.

"I am especially glad this agreement does not include a single penny for the construction of a misguided wall along our southern border," he said. "This bipartisan agreement eliminates more than 160 poison pill riders that would have been devastating for the environment, put restrictions on consumer financial protections and attacked the Affordable Care Act."
